Ad hoc mediator (“self-employed”) or through the mediation and arbitration chambers where I am listed (CAMERS, FIESP/CIESP and CAMARB).
- Acting with evaluative and proactive approach to seek a consensual solution that puts an end to the dispute, balancing results, and interests, and seeking to preserve, whenever possible, the relationship between the parties.
- My experience as a lawyer in Brazil working in thousands of lawsuits is also an important background to conduct mediations especially in the business area
- This expertise helps to measure risks and proactively collaborate in the creation of consensual solutions together with the parties and their lawyers in one or more mediation sessions
Mediation is a consensual and confidential procedure, based on facilitating the negotiation of an agreement between the parties.
The mediator does not judge or take sides in the resolution of the dispute. It seeks incessantly and neutrally, through different techniques, to build with the parties and their lawyers a solution that will put an end to the litigation.
In countries like the United States, where I have developed the most substantial part of my training as a mediator, more than 90% of cases are resolved through mediation or arbitration.
